This particular stretch of guardrail had been severely damaged for many months, but neither the Georgia Department of Transportation nor any of the private contractors that the state hired to monitor and repair guardrail did anything about it. The contractors just drove past and looked at the broken guardrail.
Our clients' mother was a passenger in an SUV one night that lost control after contact with another vehicle and struck the guardrail where it was already damaged. If the guardrail had been intact, the SUV would have slid to a stop, nobody would have been hurt, and we would never have had to take this deposition. But because the guardrail was already severely damaged, the SUV flipped over the guardrail and slammed into a GDOT camera pole just on the other side. The impact with the pole caved in the SUV's roof, killing our clients' mother.
